Holding
The appellate court ordered that the pending suit be proceeded with and the appellant remain in possession of the property until that suit is disposed, without expressing any opinion on the merits.
Summary
Maratha Mitra Mandal & Ors. appealed a January 2018 order of the City Civil Court, Bombay, which dismissed their suit seeking protection from dispossession. While the appeal was pending, Defendant No.2, Siddhivinayak Co‑operative Housing Society, instituted a new suit (No. 2266 of 2025) in the City Civil Court to dispossess the appellants. The High Court, by consent, heard the appeal at the admission stage and, without addressing the merits, ordered that the new suit proceed and that the appellants remain in possession of the property until that suit is finally decided. The court also directed that the appellants may raise all contentions in the pending suit and prohibited them from creating any third‑party rights over the property. The appeal and the accompanying civil application were disposed of on these terms.
Issues considered
- What interim relief, if any, should be granted to the appellant pending the disposition of the new suit filed by Defendant No.2?
