An anticipatory bail application may be withdrawn by the applicant, resulting in its dismissal and the disposal of any related interim application.

Summary

The Bombay High Court examined an anticipatory bail application filed by Shreeyash Manik Jagtap in connection with C.R. No.178 of 2025, where all accused had surrendered. Earlier, the court had declined pre‑arrest bail, citing the seriousness of the offence, but noted concerns about police conduct and issued detailed orders. The applicant, through counsel, subsequently sought to withdraw the anticipatory bail application. The court permitted the withdrawal, dismissed the anticipatory bail application, and consequently disposed of the related interim application. No further relief was granted.

Issues considered

  • Whether anticipatory bail can be granted in a case involving a serious offence.
  • Whether the applicant may withdraw an anticipatory bail application after the court has expressed its view on pre‑arrest bail.
  • Effect of the withdrawal of anticipatory bail on a pending interim application.

Subjects

  • anticipatory bail
  • pre‑arrest bail
  • withdrawal of application
  • serious offence
  • criminal procedure
