RAJENDRA RAMCHANDRA BAJAREversusMALTI RAJENDRA BAJARE

Decided
Disposal

Holding

The court held that the delay is condoned as the appellant’s reasons are satisfactory and no prejudice is shown to the respondent.

Summary

The appellant, Rajendra Ramchandra Bajare, filed an interim application seeking condonation of a 213‑day delay in filing his appeal. He explained that, being a senior citizen with limited financial means and health problems, he required additional time to engage counsel and prepare the necessary documents. The court examined whether the reasons provided justified condoning the delay under the principles of natural justice and procedural law. Satisfied that the appellant’s circumstances were genuine and that no prejudice was caused to the respondent, the judges granted the condonation. Consequently, the interim application was disposed of, allowing the appeal to proceed. No statutory or case law citations were required for this determination.
