The court held that the sentences are to be suspended until final disposal of the appeals and bail is to be granted on a personal bond and surety with periodic reporting conditions.

Summary

The High Court admitted appeals by Akhilesh Harshal Pandey and Anoop Roy against convictions in CBI Special Cases No.35 of 2011 and No.36 of 2012, where a Special Judge had imposed imprisonment. Both appellants filed interim applications seeking suspension of their sentences and bail. Noting a similar order in Criminal Appeal (ST) No.10627 of 2026 that suspended the co‑accused’s sentence, the Court ordered that the substantive sentences of the appellants be suspended pending final disposal of the appeals. The Court also granted bail on a personal bond of Rs 25,000 and an equal surety, subject to the condition that the appellants appear at the CBI office on the first Monday of July and January each year until disposal. The interim applications were disposed of in favour of the appellants, while the main appeals remain pending.

Issues considered

  • Whether the substantive imprisonment sentences should be suspended pending appeal.
