The interim application is partly allowed, granting the applicant two weeks to furnish the surety by depositing cash and executing a bond, with additional reporting conditions.
Summary
The High Court considered an interim application filed by Sara Ismail Aadam, who had been released on bail for offences under the NDPS Act, Passport Act and Foreigners Act. The applicant was unable to furnish the required surety within the time stipulated in the original bail order dated 12-12-2025. She undertook to comply with condition no.8(ii) of that order within 15 days of her release. The Court partially allowed the interim application, granting her two weeks to provide the surety by depositing a Rs.1,00,000 cash security and executing a Rs.50,000 personal bond, with the cash to be returned upon furnishing the surety. Additionally, the Court directed that she report every third day to Vashi Police Station and be allowed to leave to satisfy bail conditions. The interim application was thereafter disposed of.
Issues considered
- Whether the applicant should be granted additional time to furnish the surety required under the bail order
- Whether the Court can modify bail conditions by allowing a cash security and personal bond in lieu of the surety
