The Court restored the dismissed commercial arbitration application, subject to payment of Rs.2,500 costs.

Summary

Kotak Mahindra Bank Ltd filed a commercial arbitration application (No. 161 of 2026) which was dismissed on 30 April 2026 for non‑prosecution because the bank’s counsel failed to appear. The bank applied for restoration, explaining that the non‑appearance was inadvertent. The High Court considered whether the dismissal could be set aside and whether restoration could be conditioned on costs. The Court held that the application could be restored, subject to the payment of Rs.2,500 to the High Court Advocates' Association. Consequently, the interim application for restoration was allowed, the arbitration case was reinstated, and a notice was issued to the respondent for a hearing on 7 August 2026.
