The Court ordered the university to accept the applicants’ examination forms and allow them to appear for the May 2026 examinations, subject to the final decision on the writ petition.

Summary

The applicants, students who had cleared third‑year studies but still held backlogs from the second year, were provisionally admitted to the fourth year of their degree by a circular issued by Savitribai Phule Pune University. After appearing for and passing the backlog examinations in October‑November 2025, the university issued a letter on 10 April 2026 stating that provisionally admitted students could sit for the fourth‑year exams only after a High Court decision. The applicants filed interim applications seeking permission to appear for the scheduled May 2026 examinations. The Court, noting its earlier orders on 27 April, 7 May and 18 May 2026 allowing similarly situated students to sit for exams, directed the university to accept the applicants’ examination forms and permit their appearance, subject to the final outcome of the writ petition. The order was limited to the present applicants, required verification of eligibility within 24 hours, and kept all substantive rights open for determination in the main writ petition.

Issues considered

  • The legality and applicability of the university’s ‘carry on’ system for provisionally admitted students
  • Whether students with cleared backlogs but provisional admission may be allowed to sit for fourth‑year examinations pending judicial review

Subjects

  • provisional admission
  • backlog clearance
  • carry on system
  • interim relief
  • university examinations
  • high court order
