Bombay High Court

AMIT RAMCHANDRA BADDIversusSTATE OF MAHARASHTRA

Decided

Holding

The Court modified condition (c) of the bail order, directing the applicant to attend Rajarampuri Police Station, Kolhapur, on the specified days.

Summary

The applicant, Amit Ramchandra Baddi, filed an interim application seeking modification of condition (c) of the bail order dated 30 July 2024, which required his monthly attendance at ATS Kalachowki, Mumbai. He argued that, being ordinarily resident in Hubli, Karnataka, and also an accused in a case at Rajarampuri Police Station, Kolhapur, it would be unduly burdensome to travel to Mumbai each month. The respondent's counsel, on instruction from the ATS officer, indicated no serious objection to a modification. The Court, after considering the convenience and the lack of opposition, altered condition (c) to require the applicant to attend Rajarampuri Police Station on every Tuesday in the second week of each month between 10.00 a.m. and 12.00 noon, while keeping the other bail conditions unchanged. The application was allowed.

Issues considered

  • Whether the bail condition mandating monthly attendance at ATS Kalachowki, Mumbai, can be modified to attendance at a nearer police station due to the applicant's residence and concurrent charges.

Subjects

  • bail
  • modification of bail conditions
  • attendance requirement
  • interim application
  • criminal appellate jurisdiction
