SOMA SUNDARAM MAYAVAN ARJUNversusSTATE OF MAHARASHTRA

The court allowed the applicant to be released on cash bail of Rs. 25,000 with an undertaking to furnish sureties within four weeks.

Summary

The High Court of Bombay, on 13 January 2026, considered an interim application filed by the applicant, who had been granted bail on 16 July 2025 with a condition to furnish a personal bond of Rs. 25,000 backed by sureties. The applicant’s counsel argued that the applicant’s relatives could not find sureties of the required amount, causing the applicant to remain in jail despite the bail order. The court examined whether the applicant could be released on a cash bail of Rs. 25,000 pending the procurement of sureties. It held that the applicant may be released on cash bail and be required to provide one or two sureties of the same amount within four weeks, subject to acceptance by the trial court. Consequently, the interim application was partly allowed and disposed of, enabling the applicant’s provisional release.
