The Court allowed the interim application, condoned the delay and restored the writ petition.

Summary

The applicant, the legal heir of the deceased Bhimabai Baburao Kadam, filed an interim application seeking restoration of a writ petition that had been dismissed for non‑prosecution on 20 April 2026. The Court examined the reasons set out in paragraphs 4 and 5 of the application and was persuaded that the delay in filing the restoration request could be condoned. Accordingly, the Court allowed the application, recalled the dismissal order, and restored the writ petition to the file. The delay was expressly condoned and the petition was listed for further hearing on 31 July 2026. The order thus reinstated the original proceedings for consideration.
