The three‑day delay in filing the arbitration petition is condoned.

Summary

HDFC Securities Limited filed an application before the Bombay High Court seeking condonation of a three‑day delay in filing its arbitration petition under Section 34 of the Arbitration and Conciliation Act, 1996. The notice of the application for condonation was served on the respondent, Veeresh Radharam, on 12 March 2026, but the respondent did not appear. The applicant pleaded justifiable reasons for the short delay. The Court, after considering the brevity of the delay and the interest of substantive justice, held that the delay merited condonation. Accordingly, the application was allowed and the arbitration petition was ordered to be numbered and listed for admission after two weeks.
