Summary

The applicant, Rekha Purshottam Shewale, filed an interim application to bring the legal heirs of the deceased appellant, Smt. Dhyanubai R. Shinde, onto the record in Criminal Appeal No. 100 of 2024. The appellant had died on 19 August 2025, and the application was filed 112 days later, raising a question of delay. Counsel for the applicant pleaded for condonation of the delay, arguing that the omission should not prejudice the proceedings. The Court examined the principles governing condonation of delay and abatement, and decided to condone the delay, setting aside any abatement that might have arisen. Consequently, the application was allowed, and the parties were directed to amend the records within two weeks as per the schedule in the application.
