Holding

The petition is dismissed as it is not a public interest litigation and lacks substantive merit.

Summary

Mohammed Ismail Abdul Khalik filed a petition seeking a direction to a Special Investigation Team regarding several FIRs and a declaration that section 9 of the Foreigners Act, 1964 is unconstitutional. The respondents, including the State of Maharashtra and the Union of India, submitted that the 1946 Foreigners Act has been repealed and replaced by the Immigration and Foreigners Act, 2025, and that its constitutional validity had been upheld by the Supreme Court in Sarbananda Sonowal v. Union of India (2005). The Court observed that the petition did not qualify as a public interest litigation and lacked substantive merit. Consequently, the Court dismissed the petition, holding that no relief could be granted.

Issues considered

  • Whether the petition qualifies as a public interest litigation.
  • Whether section 9 of the Foreigners Act, 1964 is unconstitutional or ultra vires.
