Disposal
DISPOSED OFF

Holding

The Court quashed the impugned order and directed the Scrutiny Committee to issue a Tribe Validity Certificate to the petitioners as belonging to the Koli Mahadev Scheduled Tribe.

Summary

The petitioners, Yogita Hanmant Ronte and another, filed a writ petition seeking a Tribe Validity Certificate recognizing them as members of the Koli Mahadev Scheduled Tribe. They relied on a prior order dated 01.08.2023 in Writ Petition No.9144 of 2023, which had quashed a Scrutiny Committee order and directed issuance of such a certificate to their brother. The respondents, the State of Maharashtra, did not dispute the factual relationship between the petitioners and the earlier case. The Court, noting the similarity, partially allowed the present petition, quashed the impugned order, and directed the Scrutiny Committee to issue the Tribe Validity Certificate to the petitioners, subject to any decision in the reopened matters. The petition was thereafter disposed.

PC :-

1. Learned Advocate for the petitioners has placed on record a copy

of order dated 01.08.2023 passed by this Court in Writ Petition No.9144

of 2023, thereby quashing and setting aside the order passed by the

Respondent No.2/Scrutiny Committee and further directing the Scrutiny

Committee to issue a Tribe Validity Certificate to the petitioners

immediately as belonging to “Koli Mahadev”, (Scheduled Tribe).
                                    (2) 948-WP-10113-2025

2. The learned Advocate for the petitioners submits that the said

petition was filed by the real brother of the present petitioners, who was

granted a Tribe Validity Certificate, subject to decision taken by the

Committee in a case that was reopened in respect of the relative of the

present petitioners.

3. Learned AGP does not dispute the said position and fact that the

present petitioners happen to be the real sisters of the petitioner, Yogesh

Hanmant Ronte, in Writ Petition No.9144 of 2023.

4. We, therefore, deem it appropriate to pass similar order in the

present writ petition. Hence, following order:

                              ORDER

       (i) The writ petition is partly allowed.

(ii) The impugned order is quashed and set aside.

(iii) The committee shall immediately issue tribe validity

certificate to the petitioners as belonging to “Koli Mahadev”

Scheduled Tribe, which shall be subject to the decision to be

taken by the Committee in the reopened matters.
                                         (3) 948-WP-10113-2025

(iv) Writ petition stands disposed off.

             (v) Parties to act upon authenticated copy of this order.
