The order dated 03.08.2015 of the Commissioner of Fisheries is unsustainable and must be quashed.
Summary
The petitioner, Gangaputra Mastsyavayasay Sahakari Sanstha Ltd, challenged an order dated 03.08.2015 issued by the Commissioner of Fisheries, Maharashtra, in Revision Application No. 6 of 2015. The High Court noted that a later judgment dated 18.04.2026 in Writ Petition No. 6807 of 2017 rendered the challenged order unsustainable. Consequently, the Court ordered the quashing of the 2015 order. The Court directed the petitioner to approach the State Government within eight weeks for any further relief. It also instructed the concerned authority to consider limitation issues and decide the revision on its merits within six months, after which the writ petition was disposed.
Issues considered
- Whether the order dated 03.08.2015 of the Commissioner of Fisheries is sustainable in view of the later judgment in Writ Petition No. 6807 of 2017.
- Whether the petitioner is barred by limitation from seeking relief.
- Whether the revision application should be entertained and decided on merits.
