PRAMESHWAR HARIBHAU PATOLE AND OTHERSversusTHE STATE OF MAHARASHTRA THR ITS SECRETARY AND OTHERS

Disposal
DISPOSED OFF

Holding

The court held that the respondents must pay the award amount and the statutory interest mandated by Section 80 of the RFCTLARR Act.

Summary

The petitioners, Prameshwar Haribhau Patole and others, filed a writ petition before the Bombay High Court, Aurangabad bench, seeking payment of an award amount and interest that they claimed were due under Section 80 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013. The respondents, the State of Maharashtra and others, had failed to make the payment. The Court examined whether the award and statutory interest were enforceable under the said provision, relying on its earlier order in Writ Petition No. 14392 of 2025 and the precedent set in Hatim Fidaali Rajkotwala & Anr. v. Land Acquisition Officer (2023). It held that the respondents were legally bound to honour the award and pay the interest as prescribed by the Act. Consequently, the petition was allowed and the respondents were directed to discharge the amount within three months of receiving the order.

Issues considered

  • Whether the respondents are liable to pay the award amount under Section 80 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013
  • Whether statutory interest is payable on the award amount under the same provision
