MAROTI RAMRAO CHILLEWAD AND OTHERSversusTHE STATE OF MAHARASHTRA THR ITS PRINCIPAL SECRETARY AND OTHERS

Disposal
DISPOSED OFF

Holding

Clause 3 of the Government Resolution is discriminatory and violative of Article 14, and the impugned orders are quashed; the petitioners are entitled to the subject‑teacher pay scale and arrears as directed.

Summary

The petitioners, a group of subject teachers of classes 6 to 8, challenged Clause 3 of the Government Resolution dated 13‑10‑2016, alleging it was discriminatory and violated Article 14 of the Constitution. The High Court examined whether the clause unjustly denied the petitioners the subject‑teacher pay scale and related arrears. It held that the clause indeed contravened the equality principle under Article 14. Consequently, the court quashed the impugned orders and directed the Zilla Parishads to grant the appropriate pay scale to teachers appointed before acquiring the requisite qualification, as well as to those who obtained the qualification during service, with arrears payable within eight weeks. The writ petitions were allowed and disposed of.
