BASLING SHANTLING TAGDE AND OTHERSversusTHE STATE OF MAHRASHTRA AND OTHERS

Disposal
DISPOSED OFF

Holding

The Court directed the respondent to complete the acquisition process and pass the compensation award within two months, thereby disposing of the petition.

Summary

The petitioners filed a writ petition seeking a direction to the State of Maharashtra to pass a compensation award under the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013. The respondent’s Attorney General argued that a Section 19 notification had been issued and the award would be passed within two months. The Court examined the submission and found no impediment to granting the direction. Accordingly, the Court ordered the acquiring authority to complete the acquisition proceedings and issue the award within two months of the order. The petition was then disposed of.

Issues considered

  • Whether the Court can direct the State to pass a compensation award under the RFCTLARR Act, 2013
  • Whether the issuance of a Section 19 notification suffices to compel the award within a specified period
