PEDRU ALEX RODRIGUES AND ORSversusTHE STATE OF MAHARASHTRA THRU SECRETARY AND ORS

Decided

Disposed Off

Holding

The petition is dismissed as the orders under the Maharashtra Co‑operative Societies Act are already being implemented.

Summary

The petitioners sought a writ directing the Assistant Registrar of Co-operative Societies to implement the recommendations of an inquiry report made under Sections 78 and 78A of the Maharashtra Co-operative Societies Act, 1960, which arose from an inquiry under Section 83. The State, represented by the Attorney General, produced a notice dated 25‑08‑2026 showing that steps were already being taken to give effect to the competent authority’s orders. The Court examined the notice and found that the implementation was in progress. Consequently, the Court held that the petitioners had no further grievance to raise. The writ petition was therefore dismissed.

Issues considered

  • Whether the Assistant Registrar should be directed to comply with the inquiry report under Sections 78/78A of the Maharashtra Co-operative Societies Act, 1960.
  • Whether the petitioners have any remaining grievance warranting judicial intervention.

                      DATED : 29th SEPTEMBER, 2026

P.C:-
1. The Writ Petition seeks a direction to the Assistant Registrar,
Co-operative Societies, to comply with the direction and
recommendation made in the inquiry report under Section 78 / 78A of
the Maharashtra Co-operative Societies Act, 1960, arising out of the
recommendations in the inquiry conducted under Section 83 of the
Act.

2. The learned AGP has placed before us an order passed on
25/08/2026 in the form of notice under section 78A(1)(b), with
reference to the inquiry under Sections 83/88, and from its perusal, it
is evident that appropriate steps for taking the orders to its logical end
and conclusion are being taken.

The copy of the said notice is taken on record and marked as
‘X’ for identification. The same is also served to the learned counsel
for the Petitioner.

3. In our view, the Petitioner has no reason to make further
grievance, as the orders passed by the Competent Authority are under
implementation through the Assistant Registrar. Hence, we dispose of
the writ petition.
