SNEHAL SUNIL SALVIversusDISTRICT MAGISTRATE RATNAGIRI ANDORS

Disposal
Disposed Off

Holding

The petition is dismissed for non‑prosecution.

Summary

The petitioner filed a writ petition challenging an order dated 11 September 2024 that was passed under Section 14 of the SARFAESI Act. The petitioner argued that the order was improper, although the statute also provides an alternate remedy under Section 17. No counsel appeared on behalf of the petitioner, and no interim relief was sought. The Court observed that the proceedings had effectively reached their conclusion and that the petitioner had failed to prosecute the petition. Consequently, the Court dismissed the petition for non‑prosecution.

Issues considered

  • Whether the order passed under Section 14 of the SARFAESI Act is maintainable in a writ petition when an alternate remedy under Section 17 exists
  • Whether the petition can be entertained despite the petitioner’s failure to appear and prosecute
