Bombay High Court
VASANT MAHADEO BORAVAKEversusTHE CIRCLE OFFICER PUNTAMBA AND OTHERS
- Disposal
- DISPOSED OFF
Holding
The court ordered that the same relief granted in the earlier petitions be granted in the present petition.
Summary
The petitioner, Vasant Mahadeo Boravake, filed a writ petition seeking relief that had previously been adjudicated by the same court in Writ Petition Nos. 3974/2020 and 3978/2020. The petitioner’s counsel submitted the order dated 08‑04‑2022 from those earlier cases, urging that the same order be granted here. The learned Additional Government Pleader for the respondent confirmed that the issues were identical. The bench, noting the prior decision and the submission of the earlier order, held that the same relief should be granted in the present petition. Consequently, the petition was allowed in accordance with prayer clauses (B) and (C).
Issues considered
- Whether the relief sought in the present writ petition is identical to that decided in Writ Petition Nos. 3974/2020 and 3978/2020 and therefore should be granted.

...
Mr. Sanket S. Kulkarni and Mr. S. D. Kulkarni, Advocate for the
Petitioner.
Mr. R. B. Dhaware, AGP for Respondent-State.
...
CORAM : SIDDHESHWAR S. THOMBRE, J.
DATE : 9th MARCH 2026
P.C.:-
1. The identical issue has already been decided by this Court
in the case of Vasant Mahadeo Boravake Vs. The Circle Officer & Ors.
In Writ Petition No. 3974 of 2020 with Writ Petition No.3978 of 2020 .
The learned AGP also fairly confirms the same. I am inclined to take
the same view.
2. Mr. Sanket S. Kulkarni and Mr. S. D. Kulkarni tender a copy
of the order dated 08.04.2022 passed in the said petitions and submits
that a similar order deserves to be passed in the present petition.
3. As the order passed in Writ Petition Nos.3974 of 2020 with
3978 of 2020 squarely applies to the present case, the similar order is
passed in the present petition.
4. For the aforesaid reasons, the petition is allowed in terms
of prayer clause (B) and (C).
