BHAGWAT VITTHAL WANVEversusTHE STATE OF MAHARASHTRA AND OTHERS

Disposal
DISPOSED OFF

Holding

The order dated 28‑August‑2017 is quashed and set aside.

Summary

Bhagwat Vitthal Wanve filed a writ petition challenging an order dated 28 August 2017 issued by the Revenue Minister in Appeal‑2/2016/C.No.122/J‑7(A). The petitioner argued that the order was invalid due to undue delay. The learned Minister had already set aside the order on the ground of delay, and the Court noted that the matter was already decided in Writ Petition No. 13712/2017 on 22 April 2026. Relying on that precedent, the Court held that the challenged order must be vacated. Consequently, the writ petition was allowed and the 28‑August‑2017 order was quashed.
