Clause 3 of the Government Resolution dated 13‑10‑2016 is discriminatory and violative of Article 14, and the petitioners are entitled to the subject‑teacher pay scale and arrears.

Summary

A large group of teachers filed writ petitions challenging Clause 3 of the Government Resolution dated 13 October 2016, which denied them the subject‑teacher pay scale. The petitioners argued that the clause discriminated against them in violation of Article 14 of the Constitution. The Court referred to its earlier decision in Ganesh Mahadeo Asekar v. State of Maharashtra (Writ Petition No. 5563 of 2022) which had held the same clause unconstitutional. Relying on that precedent, the Court declared Clause 3 discriminatory, quashed the impugned orders, and directed the Zilla Parishads to grant the subject‑teacher pay scale and any arrears from the date of appointment or qualification. The writ petitions were allowed and the matter was disposed of.

Issues considered

  • Whether Clause 3 of the Government Resolution dated 13‑10‑2016 violates Article 14 of the Constitution as applied to the petitioners.
  • Whether the petitioners are entitled to the subject‑teacher pay scale and arrears of pay.
