Clause 3 of the Government Resolution dated 13 October 2016 is discriminatory and violative of Article 14, and the petitioners are entitled to the subject‑teacher pay scale and arrears.

Summary

The Bombay High Court, Aurangabad Bench, allowed writ petitions filed by subject teachers challenging Clause 3 of the Government Resolution dated 13 October 2016. Relying on the Nagpur Bench’s decision in Ganesh Mahadeo Asekar v. State of Maharashtra (W.P. No. 5563 of 2022), the Court held that the clause was discriminatory and violated Article 14 of the Constitution. Consequently, the impugned orders against the petitioners were quashed. The Court directed the Zilla Parishads to grant the subject‑teacher pay scale to the petitioners from the date of their appointment or from the date they acquired the requisite qualification, and to pay any arrears within eight weeks. The writ petitions were therefore allowed and disposed of.

Issues considered

  • Whether Clause 3 of the Government Resolution dated 13 October 2016 is discriminatory and violative of Article 14 of the Constitution in respect of subject teachers.
  • Whether the petitioners are entitled to the subject‑teacher pay scale and arrears from the date of appointment or qualification.
