PRADIP S/O. RAMRAO SHINDE AND OTHERSversusTHE UNION OF INDIA AND OTHERS

Disposal
DISPOSED OFF

Holding

The direction sought under Section 4 of the MPID Act has been substantially complied with, and the petition is dismissed.

Summary

The petitioners filed a criminal writ petition seeking a direction for attachment of properties under Section 4 of the Maharashtra Protection of Interest of Depositors (In Financial Establishments) Act, 1999. The Assistant Public Prosecutor placed on record a communication dated 20 August 2026 along with the requisite notification issued under the same section. The petitioner's counsel argued that the direction sought had not been complied with, while the respondent's counsel contended that the notification satisfied the petitioners' demand. The Court examined the communication and notification and found that the attachment direction had been substantially complied with. Consequently, the Court held that there was no remaining ground for relief and disposed of the petition.

Issues considered

  • Whether the petitioners are entitled to a direction for attachment of properties under Section 4 of the MPID Act
