GOVIND TUKARAM GANGATIRE THROUGH POWER OF ATTORNEY DIGAMBAR VISHWANATH GANGATIREversusRAMPRASAD MAROTIRAO GANGATIRE

Disposal
DISPOSED OFF

Holding

The appointment of a court commissioner before oral evidence is improper, and the order appointing the commissioner is stayed.

Summary

The petitioner, originally a defendant in a civil suit, challenged an order dated 5 August 2019 that appointed a court commissioner before any oral evidence was taken. The High Court noted its consistent jurisprudence that a court commissioner should normally be appointed only after the recording of oral evidence is completed. Relying on a series of prior decisions, the Court stayed the impugned order and directed that the commissioner’s report be sealed until the parties have led their evidence. The petition was thereafter disposed of with a direction to the trial court to open the report post‑evidence. Consequently, the writ petition was dismissed without prejudice to further proceedings.

Issues considered

  • Whether a court commissioner can be appointed before the commencement of oral evidence in a civil suit.
  • Whether the order appointing the commissioner should be stayed pending the recording of evidence.

Subjects

  • court commissioner
  • oral evidence
  • stay order
