Bombay High Court

NARAYAN BALWANT PATILversusTHE DISTRICT COLLECTOR, SATARA

Disposal
Disposed Off

Holding

The petition is not maintainable because an alternative remedy under the Maharashtra Cooperative Societies Act, 1960 is available.

Summary

The petitioner, Narayan Balwant Patil, filed a writ petition challenging a notice issued by the District Collector under Rule 107 of the Maharashtra Cooperative Societies Rules, 1961. The central issue was whether the petition could be entertained when an alternative remedy exists under the Maharashtra Cooperative Societies Act, 1960. The Court examined the availability of that statutory remedy and concluded that the petitioner should pursue it instead of the writ jurisdiction. Consequently, the Court declined to entertain the petition. The petition was disposed of, with liberty granted to the petitioner to adopt the appropriate remedy under the Act.
