Bombay High Court

JAYDEEP MAHADEV DEVKARversusSTATE OF MAHARASHTRA THR ITS SECRETARY AND ORS

Disposal
Disposed Off

Holding

The petition was disposed after allowing the petitioner to withdraw it, with no order directing appointment.

Summary

The petitioner, Jaydeep Mahadev Devkar, filed a writ petition seeking direction for his appointment as Police‑Patil under the State of Maharashtra. The Court, after hearing counsel for both sides, expressed displeasure at granting relief given the peculiar facts of the case. The petitioner was permitted to withdraw the petition while keeping his contentions open for future application when a vacancy is advertised. The Court noted that the impugned order would not obstruct the petitioner’s qualification for the post if he otherwise meets the legal criteria. Consequently, the petition was disposed without any substantive order on the merits.

Issues considered

  • Whether the petitioner is entitled to be appointed as Police‑Patil under the applicable law
  • Whether the impugned order constitutes a hindrance to the petitioner’s qualification for the post
