The petition is allowed and the FIR and chargesheet are quashed, subject to each party paying Rs. 50,000 costs.

Summary

The petitioner filed a writ under Article 226 of the Constitution and Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, seeking quash of FIR No. 251 of 2012 and the related chargesheet for an alleged offence under IPC Section 354. Both parties admitted that the dispute arose from a misunderstanding between friends and had been amicably settled, with the complainant filing an affidavit stating no objection to quashing. The State, through its APP, consented to the quash but suggested costs be imposed for filing a private dispute with police. Relying on Supreme Court precedents that allow dismissal of criminal proceedings where the complainant withdraws support, the Court held that continuing the case would serve no useful purpose. Accordingly, the petition was allowed, the FIR and chargesheet were quashed, and each party was ordered to pay Rs. 50,000 as costs.

Issues considered

  • The Court’s jurisdiction to quash an FIR under Article 226 and Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023.
  • Whether a criminal proceeding for an alleged offence under IPC Section 354 can be dismissed on the ground of an amicable settlement and the complainant’s withdrawal of support.
  • Whether costs may be imposed on parties for initiating a private dispute before the police.
