Bombay High Court

PRAVIN RAJU SHRIKHANDEversusTHE STATE OF MAHARASHTRA THROUGH COLLECTOR DHULE AND OTHERS

Disposal
DISPOSED OFF

Holding

The Court held that the petitioners may obtain release of their seized vehicles by depositing 25% of the penalty under Section 256 of the Maharashtra Land Revenue Code while pursuing an appeal.

Summary

The petitioners challenged orders dated 14.01.2026 and 17.02.2026 issued by the Sub‑Divisional Officer, Dhule under Section 48 of the Maharashtra Land Revenue Code, which imposed a penalty and seized their vehicles. Their counsel acknowledged that an appeal is available and proposed that the vehicles be released if the petitioners deposit 25% of the penalty as mandated by Section 256 of the same Code. The Court held that the writ petitions are disposed, granting the petitioners liberty to approach the appellate authority and, subject to a 25% deposit and usual undertaking, to have their vehicles released. No substantive stay of the S.D.O.’s orders was granted; the matter was left to the appellate authority. The petitions were therefore dismissed, with directions for possible release upon compliance with Section 256.

Issues considered

  • Whether the orders of the Sub‑Divisional Officer imposing penalty and seizing the vehicle under Section 48 of the Maharashtra Land Revenue Code are amenable to writ jurisdiction.
  • Whether the petitioners are entitled to release of the seized vehicle pending appeal upon depositing 25% of the penalty under Section 256 of the Maharashtra Land Revenue Code.

                     PER COURT :-

                     1. Present writ petitions takes exception to the orders dated

14.01.2026 and 17.02.2026 respectively passed by the Sub

                     2. Learned advocate appearing for the petitioner/s fairly

concedes that remedy of appeal is available to the petitioner/s
