RAJASTHANI EDUCATION SOCIETY THROUGH ITS PRESIDENT AND ORSversusTHE STATE OF MAHARASHTRA THROUGH SECRETARY AND ORS

Disposal
DISPOSED OFF

Holding

The Court held that respondent No.3 must decide the proposal dated 16‑10‑2025 within two months from the date of the order.

Summary

The Rajasthani Education Society filed a writ petition seeking a direction to the State of Maharashtra to decide a proposal dated 16‑10‑2025 for granting approval to the Society's appointment as a Shikshan Sevak. The petitioners argued that the decision was unduly delayed, affecting their right to the appointment. The respondents, through their advocates, waived service of notice and the advocate for respondent No.3 stated that the proposal would be decided within two months, which the court treated as an undertaking. The High Court examined whether it could compel the administrative authority to act within the stipulated period. Finding the undertaking sufficient, the Court directed respondent No.3 to decide the proposal within two months from the date of the order and disposed of the petition.
