- DISPOSED OFF
Holding
The Court ordered that the petitioner be permitted to file a fresh representation and that the competent authority must consider it expeditiously within three months, without deciding the substantive merits.
Summary
Pritesh Narharibhai Patel filed a writ petition under Article 226 seeking a mandamus directing the State of Maharashtra to consider his 2013 representation for rehabilitation in lieu of an RCC shed on land in Borivali. He alleged that the representation was not acted upon and was later declared untraceable, prompting a request for liberty to file a fresh representation. The Court declined to examine the substantive merits of the rehabilitation claim. Instead, it directed that the petitioner be allowed to submit a fresh representation within two weeks and that the competent authority consider it within three months, after hearing all stakeholders. The petition was disposed without adjudicating the underlying issue.
Issues considered
- Whether the Court should issue a mandamus directing the Respondent to consider the 2013 representation.
