The petition is partly allowed, directing the Thane Municipal Corporation to act on the complaint within eight weeks and to examine the Section 260 notices, with the question of the petitioner's delay left open.

Summary

Mr. Jayesh H. Gupta filed a writ petition seeking the Thane Municipal Corporation (respondents 2‑6) to act on his complaint dated 01‑01‑2026 regarding unauthorized constructions encroaching the Anand Koliwada Main Road, which is shown without proper width in the draft development plan under Section 26 of the Maharashtra Regional and Town Planning Act, 1966. The petitioner alleged that notices issued under Section 260(1)(2) of the Maharashtra Municipal Corporations Act were not enforced and that the corporation had failed to address his repeated complaints. The court limited its consideration to the specific prayer directing the corporation to take action on the complaint. The respondents undertook to decide the representation within eight weeks, which the petitioner did not contest. The court partly allowed the petition, ordering respondents 2‑6 to act on the complaint within eight weeks and directing respondent 6 to examine the Section 260 notices and take appropriate action, while leaving the issue of the petitioner's delay open. The petition was disposed of on these terms.

Issues considered

  • Whether the Thane Municipal Corporation is obligated to act on the petitioner's complaint dated 01‑01‑2026 concerning unauthorized construction on a road shown in the draft development plan.
  • Whether the corporation must enforce notices issued under Section 260(1)(2) of the MMC Act.
  • Whether the petitioner's alleged delay affects the relief sought.
