Bombay High Court

VILAS NEMINATH KANODE AND ANOTHERversusTHE STATE OF MAHARASHTRA THROUGH ITS DISTRICT COLLECTOR AND OTHERS

Disposal
DISPOSED OFF

Holding

The petition is disposed without entertaining the merits, and the interim status‑quo order remains in force.

Summary

The petitioners, Vilas Neminath Kanode and another, filed a writ petition challenging an order dated 12.03.2025 passed by the District Judge in Bhokar. They relied on an earlier order dated 19.03.2025 of this Court which directed the parties to maintain the status quo concerning possession. The petitioners argued that the civil suit evidence had been recorded and the suit was pending final arguments, rendering the lower court's order unnecessary. The Court, without examining the substantive controversy, noted the existence of the status‑quo order and chose not to interfere. Consequently, the writ petition was disposed of, leaving the interim arrangement in place until the final suit order is pronounced. The judgment was delivered by Justice S. G. Chapalgaonkar on 18 March 2026.

Issues considered

  • Whether the order dated 12.03.2025 passed by the District Judge should be set aside in view of the status‑quo order dated 19.03.2025.
