Holding

The Court directed the respondents to decide the representation within four months, maintain the status‑quo, and treated the pending civil applications as disposed.

Summary

The petitioner, Limbejalgaon Grampanchayat, filed a writ petition seeking a directive to the State of Maharashtra to consider a representation dated 16 March 2013 and to ensure that its possession of the writ property is not disturbed. The petition also requested that no third‑party interest be created and that the status‑quo already ordered by the Court be maintained. The High Court, after hearing the parties, ordered the respondents to decide on the representation within four months and to communicate the decision to the petitioner, allowing a hearing if necessary. The Court further directed that the status‑quo be maintained for the same period and that the pending civil applications be treated as disposed. Consequently, the petition was disposed with these directions.

Issues considered

  • Whether the respondents should be directed to consider the representation dated 16 March 2013.
  • Whether the status‑quo over the writ property should be maintained pending the decision on the representation.
