The petition is allowed and the respondents must pay statutory interest under Section 80 of the 2013 Act.
Summary
Petitioners Abhiman Kashinath Sanap and others filed a writ petition before the Bombay High Court, Aurangabad bench, challenging the State of Maharashtra's failure to pay statutory interest on compensation awarded under the 2013 Land Acquisition Act. The core issue was whether the respondents were liable to pay interest under Section 80 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013. The Court noted that the matter had already been decided in Writ Petition No. 14392 of 2025 and relied on the precedent set in Hatim Fidaali Rajkotwala & Anr. v. Land Acquisition Officer (2023 (6) ALL MR 751). Applying the reasoning of the earlier decisions, the Court held that the statutory interest provision is mandatory where compensation is delayed. Consequently, the petition was allowed. The respondents were directed to pay the statutory interest within three months of receiving the order.
