Bombay High Court

VISHNU DEORAO INGLE AND OTHERSversusTHE STATE OF MAHARASHTRA AND OTHERS

Disposal
DISPOSED OFF

Holding

The Court held that the respondents must pay the award amount and statutory interest to the petitioners under Section 80 of the RFCTLARR Act.

Summary

The petitioners filed a writ petition seeking payment of the award amount and statutory interest due under Section 80 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013. The petitioners alleged that the State of Maharashtra had failed to make the payment despite their representation dated 18‑02‑2026. The Court observed that the matter was squarely covered by its earlier order in Writ Petition No. 14392 of 2025 and by the precedent set in Hatim Fidaali Rajkotwala & Anr. v. Land Acquisition Officer (2023 (6) ALL MR 751). Relying on those decisions, the Court allowed the writ petition. It directed the respondents to pay the award amount along with statutory interest within three months of receipt of the order. The order thus enforces the statutory entitlement under Section 80 of the RFCTLARR Act.
