The writ petition is disposed of as withdrawn, with liberty granted to the petitioner to file an application under section 163(5) of the Bharatiya Nyay Suraksha Sanhita.

Summary

The petitioner, Irfan @ Chipdya Noor Mohd. Shaikh, filed a criminal writ petition seeking to quash a notice dated 20 December 2025 issued by the Deputy Commissioner of Police under section 163(2) of the Bharatiya Nyay Suraksha Sanhita, 2023. The State argued that the order was ex parte and that any grievance must be pursued under section 163(5) of the same Act. The petitioner, through counsel, requested permission to withdraw the petition and instead file an application under section 163(5), citing the need for a swift resolution before an upcoming election campaign. The State consented to the withdrawal and assured an expedited decision on the forthcoming application. The Court accepted the withdrawal and disposed of the writ petition, granting the petitioner liberty to approach the Deputy Commissioner as requested.

Issues considered

  • Whether a writ petition is the appropriate remedy to challenge an ex parte notice issued under section 163(2) of the Bharatiya Nyay Suraksha Sanhita, 2023.
  • Whether the petitioner must first approach the issuing authority under section 163(5) before seeking judicial intervention.
