Bombay High Court

UTKARSH MARUTI PATIL AND OTHERSversusTHE STATE OF MAHARASHTRA AND ANOTHER

Disposal
Disposed off as Withdrawn

Holding

The Court held that a writ petition may be withdrawn and the petitioner may be granted liberty to file a fresh petition.

Summary

The petitioners, Utkarsh Maruti Patil and others, filed a criminal writ petition in the Bombay High Court. After the charge-sheet was filed, they sought the Court's permission to withdraw the existing petition and to file a fresh petition incorporating the charge-sheet. The sole issue before the Court was whether it could allow such withdrawal and grant liberty to file a new petition. Justice Sandesh D. Patil granted the request, permitting the withdrawal and authorising the filing of a fresh petition. Consequently, the original writ petition was disposed of.
