MADHUKAR RAMRAO PATILversusDEPUTY CHARITY COMMISSIONER, LATUR

Disposal
DISPOSED OFF

Holding

The order of the Deputy Charity Commissioner rejecting the adjournment application is valid and the writ petition is dismissed.

Summary

Madhukar Ramrao Patil filed a writ petition challenging the order dated 31 January 2014 of the Deputy Charity Commissioner, Latur, which rejected his request for an adjournment in Change Report Enquiry Proceedings No. 451 of 2011. The petitioner argued that the order was arbitrary and sought relief. The Court examined the reasons given by the Deputy Charity Commissioner and noted that the proceedings had been made time‑bound by the Court, leaving the Commissioner with no discretion but to proceed. Finding no error in the Commissioner’s reasoning, the Court held that the petition lacked merit. Consequently, the writ petition was dismissed.

                PER COURT :
. Heard learned counsel Mr. Veer holding for Mrs. Dube.

                2. By this Writ Petition, the petitioner has challenged the order
dated 31.01.2014 passed by the Deputy Charity Commissioner, Latur
thereby, rejecting the application filed by the petitioner seeking
adjournment in the Change Report Enquiry Proceedings No.451 of
                2011 below Exh.160.

                3. I have perused the reasons assigned by the learned Deputy
Charity Commissioner while rejecting the said application. Since, the
proceedings were made time-bound by this Court, the learned Deputy
Charity Commissioner had no other alternative but to proceed with the
                matter.

                4. I do not find any fault in the impugned order. As such, the Writ
Petition is devoid of any substance and the same stands dismissed.

                                                          ( ABASAHEB D. SHINDE, J. )
