Bombay High Court

KESHAVRAO PATILBA DAPKEversusSTATE OF MAHARASHTRA AND OTHERS

Disposal
DISPOSED OFF

Holding

The petition was disposed of because the closure of the underlying proceedings left no surviving claim.

Summary

The petitioner, Keshavrao s/o Patilba Dapke, filed a writ petition (No. 4975 of 2015) along with a civil application (No. 858 of 2022) before the Bombay High Court, Aurangabad Bench. The court initially granted leave to amend the petition, directing the amendment to be filed within four weeks. Subsequently, counsel for the petitioner submitted that the underlying proceedings before the concerned authority had been closed, and therefore no relief remained to be claimed. The court accepted this submission, took the closure communication on record, and held that the petition could no longer proceed. Consequently, the writ petition was disposed of, and the pending civil application was also dismissed as there was nothing left to adjudicate.
