The consent terms are recorded as a decree and are binding only on the parties to the petition, not on any third parties.

Summary

The petitioners sought leave to amend the writ petition to implead the legal representative of a deceased proprietor and later to tender the consent terms that settled the dispute with the respondents. The Court granted both requests, allowing the amendment and the filing of the consent terms. All parties, including the society’s office bearers and the developer, admitted to having read, understood, and voluntarily executed the consent terms without coercion. The Court recorded the consent terms as a decree, marking them ‘X’, and clarified that they bind only the parties to the settlement. It was further noted that the consent terms do not affect the rights of any third parties, and the writ petition was disposed in accordance with the recorded consent.
