Bombay High Court

SAHAKAR MAHARSHI MANIKRAO DADA PALODKAR NAGRI SAHAKARI PATHSANTHA THR ITS MANAGERversusTHE DIVISIONAL JOINT REGISTRAR ADN ANR

Disposal
DISPOSED OFF

Holding

The writ petitions were disposed of, with the Court directing the respondent to decide the pending appeals within two months while maintaining the interim stay.

Summary

The petitioners challenged orders dated 27‑04‑2026 issued by the Divisional Joint Registrar, Co‑operative Societies, which stayed their applications (Nos. 8/2025 and 9/2025). The High Court, on 08‑05‑2026, issued an interim order restraining the respondent APMC from allotting a suit plot to any third party pending the resolution of the matter. Noting that the substantive appeals filed by the petitioners were still pending before the respondent (Divisional Joint Registrar), the Court directed that those appeals be decided expeditiously and disposed of the writ petitions. The interim protection ordered on 08‑05‑2026 was to remain in force until the pending proceedings are concluded. Consequently, the writ petitions were dismissed with a direction to the respondent to dispose of the pending appeals within two months.

Issues considered

  • The validity of the stay orders dated 27‑04‑2026 issued by the Divisional Joint Registrar
  • The appropriateness of the High Court’s interim direction restraining the APMC from allotting the suit plot
  • The procedural propriety of disposing the writ petitions while the substantive appeals remain pending
