Bombay High Court

SIDDHESHWAR URBAN CO OPERATIVE BANK LTD. SILLODversusTHE DIVISIONAL JOINT REGISTRAR CO OPERATIVE SOCIETIES AND ANOTHER

Disposal
DISPOSED OFF

Holding

The writ petitions are disposed of, and the respondent is directed to decide the pending appeal/application within two months, with interim protection remaining in force.

Summary

The petitioners challenged orders dated 27.04.2026 of the Divisional Joint Registrar, Co-operative Societies, which stayed their applications (Nos. 8/2025 and 9/2025). The High Court, on 08.05.2026, issued an interim order prohibiting the respondent APMC from allotting a suit plot to any third party pending the resolution of the matter. Noting that the substantive appeal/application filed by the petitioners is still pending before the first respondent, the Court directed that the writ petitions be disposed of and the respondent be ordered to decide the pending appeal/application expeditiously. The Court further directed that the interim protection remain in force until the pending proceeding is disposed of and that the respondent decide the matter within two months. Consequently, the writ petitions were dismissed and the matter was left to the pending appeal/application for final determination.

Issues considered

  • The legality of the Divisional Joint Registrar's stay orders in Applications Nos. 8/2025 and 9/2025
  • Whether the High Court should grant interim relief restraining the allotment of a suit plot
  • The appropriate disposition of the writ petitions while a substantive appeal/application remains pending
