The petition is disposed of as infructuous, subject to the liberty granted under Section 105 CPC to raise objections in the appeal.

Summary

The petitioners filed a writ petition seeking liberty under Section 105 of the Code of Civil Procedure, 1908 to raise grounds of objection in an appeal concerning a suit that had already been disposed of. The petitioners argued that the suit’s disposal rendered the writ petition infructuous, but they requested permission to file objections in the pending appeal. The Court examined whether the petition could be kept open for such a purpose. It held that the petitioners were entitled to the liberty under Section 105 to raise objections in the appeal. Accordingly, the writ petition was disposed of as infructuous, subject to the granted liberty to raise objections in the appeal.

Issues considered

  • Whether a writ petition becomes infructuous when the underlying suit is disposed of.
  • Whether the petitioners are entitled to liberty under Section 105 of the CPC to raise grounds of objection in a pending appeal.
