DASHRATH SONU SHINDE, LRS RAHIBAI AND OTHERSversusMALAN HARIBHAU RAUT

Disposal
DISPOSED OFF

Holding

The mutation entry shall be made subject to the final outcome of the pending civil suit.

Summary

The petitioners sought a direction that a mutation entry in land records be made subject to the outcome of a pending civil suit between the parties. The respondents opposed the request. The Court examined whether it could condition the mutation on the pending suit's result. It held that the mutation entry may indeed be made subject to the final determination of the civil suit. Accordingly, the Court directed that the mutation entry shall be conditional on the suit’s outcome and disposed of the writ petition.
