Bombay High Court

JAGDEEP SINGH WADHWAversusMUNICIPAL CORPORATION OF GREATER MUMBAI

Decided
Disposal
DISPOSED OFF

Holding

The Court declined to issue a writ of mandamus and disposed of the petition, directing the petitioner to make a representation to the Assistant Commissioner for further consideration.

Summary

The petitioner, a senior citizen, alleged that the operations of Cheelizza Pizza India Pvt. Ltd. caused health hazards due to smoke, odour, and noise, and claimed that the Municipal Corporation of Greater Mumbai failed to act on multiple complaints. He sought a writ of mandamus directing the corporation to suspend the restaurant's licence, shut down the premises, and pay exemplary costs. The Court examined the grievance, noted that an inspection had been carried out but no further action taken, and considered the petitioner's senior‑citizen status. Instead of granting the writ, the Court ordered the petitioner to file a comprehensive representation with the Assistant Commissioner of the concerned ward within two weeks. The Assistant Commissioner was directed to examine the representation and, if necessary, take appropriate action within six weeks, giving the restaurant an opportunity to be heard. The petition was ultimately disposed without granting the relief sought.

Issues considered

  • Whether the Municipal Corporation can be compelled by a writ of mandamus to suspend a restaurant licence on grounds of nuisance and health hazards.
  • Whether the petitioner’s senior‑citizen status warrants special relief or expedited action.
  • Whether the court should intervene in the corporation’s regulatory discretion concerning licence enforcement.

Subjects

  • senior citizen
  • public nuisance
  • municipal corporation

  • writ of mandamus
