Holding

The eviction suit is maintainable before the Small Causes Court under the Maharashtra Rent Control Act, 1999, and the writ petition is dismissed.

Summary

The petitioners filed a writ petition challenging the maintainability of an eviction suit filed by the respondent under the Maharashtra Rent Control Act, 1999, alleging that they were not recognized as tenants. The petitioners argued that the plaintiff had not acknowledged their tenancy, rendering the suit improper before the Small Causes Court. The lower courts found that the plaintiff’s plaint expressly recognized the petitioners as tenants, and the suit was based on bona‑fide requirement and non‑residence for twelve years. The High Court affirmed these findings, noting that the suit was therefore maintainable under the Act. Consequently, the writ petition was dismissed.

Issues considered

  • Whether the eviction suit is maintainable before the Small Causes Court under the Maharashtra Rent Control Act, 1999, given the alleged lack of recognition of the petitioners as tenants.
