MAHARASHTRA REGIONAL RURAL BANK EMPLOYEES ASSOCIATION NANDED THROUGH WORKING PRESIDENT C T SHINDEversusBALASAHEB MARUTI DHAS AND ANOTHER

Disposal
DISPOSED OFF

Holding

The petition was dismissed as no cause of action survived after the dismissal of the parties.

Summary

The Maharashtra Regional Rural Bank Employees Association filed a writ petition challenging actions against Balasaheb Maruti Dhas and another. Both the petitioner’s representative and respondent No.1 had been dismissed from service, and the petitioner had filed an appeal before the Central Government Industrial Tribunal (CGIT). The court observed that since the parties were no longer in service, there was no surviving cause of action or locus standi to maintain the petition. Consequently, the court disposed of the writ petition. All points were kept open for any further proceedings.
