The petition was dismissed as the grievance no longer subsisted after the minister’s order.

Summary

Nandjyot Properties & Hotels Private Limited filed a writ petition challenging the non‑communication of a Revenue Department order dated 1 August 2024 concerning R.T.S. Application No.3424 of 2024. The petitioner sought a direction for the Secretary to allow inspection of the file to verify whether the covering letter and attachment were dispatched within a reasonable time. The Court permitted the petitioner to file such an application before the concerned authority. However, since the Hon’ble Minister for Revenue had already decided the application, the petitioner’s grievance was held to have ceased to exist. Consequently, the petition was disposed of.

Issues considered

  • What relief, if any, is available to a petitioner when a ministerial order has been passed but not communicated to the petitioner?
  • Whether the court should direct inspection of the revenue department’s records in such circumstances?

P.C. :

1) Learned A.G.P. submitted that, the Hon’ble Minister for Revenue

has decided the R.T.S. Application No.3424 of 2024, by its Order dated 1 st

Petitioner as expressed in the Petition, as of today does not survive and is

accordingly disposed off.
